Can the laws of the Hague Convention be challenged in Los Angeles Superior Court for the United States?
I was in an abusive situation and choose to leave France. I made numerous attempts to get help from the American Emby. I was ured leaving France would not be an issue. I returned home and continued to have contact with the father frequently. 2 months after we left France, behind my back the father filed a Hague Petition against me, basically international kidnapping charges brought against me by the US gov. All the while he continued to speak with our child and myslef on a daily basis and lied about a vacation planned. I gave our son to him. Long story short, I appeared before the L.A Superior Court- LA and LASC-USA, French Tribunal Versailles (twice) and the Court of Appeals Versailles. Ultimately, this December 2007, the courts have choose to keep my 5 year old son in France, as he has dual nationality. French 1st. and then American. His habitual residency is France. He is French? Yet born in America? Can any lawyer help me challenge this law? American birth rite means?
